In 2024, a Canadian man named Jake Moffatt lost his grandmother. He went to Air Canada’s website to book a flight. He asked the AI chatbot about bereavement fares.

The chatbot told him he could buy a full-price ticket and apply for a refund within 90 days. He did exactly that. When he requested the refund, Air Canada said no. The actual policy—buried on their website—didn’t allow retroactive refunds.

Moffatt sued. Air Canada argued the chatbot was a “separate legal entity” and customers should verify everything it says against the official policy.

The court rejected that argument completely. The ruling was clear: the chatbot is part of your website. You are responsible for the information it provides. Air Canada “did not take reasonable care to ensure its chatbot was accurate.” The airline had to honor what the chatbot promised.

This is a watershed moment. AI hallucinations—when chatbots confidently state incorrect information—are not technical glitches you can disclaim.
